News: Safety alert: Excavators
The HSE has issued a safety alert regarding the risk of inadvertent movement of excavators when controls are not isolated. The alert describes how people have been seriously hurt when the driver accidentally touched the joystick causing the digger arm to slew. Using the safety control lever prevents this type of accident.
Make all construction workers aware of this safety alert and use it to refresh workers knowledge on good practice when working close to plant.

News: The noise gap
An HSE inspection campaign has identified disappointing standards in the use of hearing protection. Often hearing protection would be available to staff where it was needed, but there was a lack of instruction to ensure that it was used, stored and maintained. Employers also failed to ensure that emergency signals would be effective to those wearing hearing protection.

News: Paint spraying to be targeted by HSE
HSE inspectors will be visiting 1000 motor vehicle repair businesses across Great Britain, examining in particular how they prevent exposure to isocyanates found within spray paints. Inspectors will be checking on spray booth ventilation, respiratory protection, safe clearance procedures and health surveillance.

This updated guidance is aimed at those responsible for the construction and management of “higher-risk buildings”. (Those over 7 storeys or 18 metres, with 2 or more residential units or used as a hospital or care home). There are a wide range of hazardous situations which must be reported to the Building Safety Regulator.

Case law: Roofer fined for worker’s fall
Sole-trader Gary Smith from Dunstable has been fined a small amount after he organised flat roof repairs without installing edge protection. The breach became known when one of his workers suffered a fractured vertebrae and ankle in a fall.

Case law: Construction firm fined over poor asbestos control
The HSE has prosecuted a principal contractor after asbestos insulation board was removed without precautions at a former pub in Manchester. No survey had been undertaken, nor a controlled removal programme, before works took place.

Case law: Wall collapsed onto employee
A court has heard how an employee was fatally crushed when a 1.8m high retaining wall collapsed due to aggregate being placed against it by builders working for H. Mealing & Sons Limited.
The company pleaded guilty to breaching Section 2(1), Health and Safety at Work etc. Act 1974 and was fined £56,775 plus costs of £44,000.

Case law: Cooperation with the fire service is compulsory
A recent case illustrates the penalties available to courts when a person has obstructed a fire safety officer in their duties. Geraldo Zilli, the owner of a manufacturing business, failed to respond to repeated requests for information which the Cambridgeshire Fire and Rescue Service (CFRS) needed so as to evaluate compliance with fire safety duties. Eventually the authority lost patience and took him to court for “failing to provide mandatory fire safety information”. He was fined £4700.

Case law: Fined for fire safety offences
A £62,000 fine has been handed to Miller Food and Wine Limited for breaches of the Regulatory Reform (Fire safety) Order 2005. The company faced a long list of charges including poor escape routes, a lack of a working fire alarm and allowing sleeping in a premises despite a prohibition notice.

Case law: 5-year-old child injured by falling pipe
The HSE has prosecuted Sage Homes Limited and its director, Jason Scorey, after a heavy cast-iron pipe fell during work to extend a house. It struck and injured a 5-year-old child.

A shop sign making and fitting company and its director have been fined after an employee fell from an unguarded scaffolding tower and later died from his injuries.

Case law: Fork lift truck accident
A company working out of Ipswich docks, has been fined £30,000 after an employee was run over and dragged by a forklift causing serious injuries to his ankle. The young worker had been standing on a pallet alongside some bins, whilst the fork lift truck was moving. A strap got caught and pulled him off the pallet, where he was then run over.
Qube Containers Limited pleaded guilty to breaching Section 2(1), Health and Safety at Work etc Act 1974 and was fined £30,000 plus £3,752 in costs.
